1. Agreement
These Terms of Use ("Terms") form a binding agreement between you and PrimeDrive (Pty) Ltd ("PrimeDrive", "we", "us"). By creating an account or otherwise using the PrimeDrive Service, you confirm that you have read, understood and accept these Terms. If you do not accept them, do not use the Service.
2. Who can use PrimeDrive
- You must be at least 18 years old.
- You must be legally able to enter into a binding contract under the laws of Botswana.
- You must complete identity verification before listing, messaging or transacting.
- Dealerships must additionally be a registered business in their country of operation.
3. Your account
You are responsible for the security of your account, your password and every action taken on the account. You may not transfer your account or let anyone else use it. Notify us immediately at primedrive56@gmail.com if you suspect unauthorised access.
4. Listings & content
By posting a listing or any other content on PrimeDrive you confirm:
- You own the vehicle (or are authorised to sell or rent it).
- The information is accurate, complete and not misleading.
- Your content does not infringe anyone else's rights, breach any law, or include offensive material.
- You grant PrimeDrive a non-exclusive, royalty-free licence to host, display and distribute your content within the Service.
We may remove any listing that breaches these Terms or that we reasonably believe is fraudulent.
5. In-app messaging
All conversations between users must remain inside PrimeDrive. Asking another user to move the conversation off-platform (to WhatsApp, SMS, Telegram, etc.) is prohibited. We do this to protect you — chat history is the strongest evidence in a dispute. Repeated off-platform redirection attempts will result in account suspension.
6. Payments & escrow
Where you transact through PrimeDrive's payment system, funds are held in escrow by our payments partner (Orange Money or MyZaka) until both parties confirm that the deal has been completed as described. Subscription fees are charged monthly and renew automatically unless cancelled at least 24 hours before the next billing date.
All prices are quoted in Botswana Pula (BWP) unless stated otherwise. You are responsible for any taxes (including BURS-administered VAT) that apply to your transaction.
7. Dispute resolution
If a transaction goes wrong, raise a dispute through the in-app "Report a deal" flow within seven days of the agreed handover date. Our Gaborone-based support team reviews the chat history, payment records and any supporting evidence, and issues a binding decision within 10 working days. If you disagree with the decision, you may escalate to mediation under Botswana's Small Claims Court rules.
8. Things you must not do
- Post fake, stolen or misrepresented vehicles.
- Harass, threaten or discriminate against any other user.
- Use PrimeDrive to launder money, sell stolen property or commit any crime.
- Scrape, copy, reverse-engineer or otherwise abuse the Service or its APIs.
- Attempt to bypass identity verification or escrow protections.
Breach of these rules can result in immediate, permanent account termination and — where appropriate — referral to the Botswana Police Service.
9. Subscriptions, cancellations & refunds
Subscription tiers (Starter, Casual, Standard, Premium, Dealer Starter, Dealer Pro, Dealer Elite) are described on our Pricing page. You may cancel your subscription anytime — your tier benefits remain until the end of the paid period. Subscription fees are non-refundable except where required by law.
10. Service availability
We work hard to keep PrimeDrive running 24/7 but we cannot guarantee uninterrupted availability. From time to time we'll perform maintenance, and occasionally things break. We won't be liable for losses caused by short interruptions.
11. Liability
PrimeDrive is a marketplace — we facilitate connections between buyers and sellers but we are not a party to the actual transaction. To the maximum extent allowed by law, our total liability to you in any 12-month period is capped at the total fees you have paid us during that period.
Nothing in these Terms excludes liability for fraud, death or personal injury caused by our negligence.
12. Termination
You can close your account at any time from Settings > Account > Delete. We can suspend or terminate your account if you breach these Terms, or where we are required to do so by law.
13. Governing law
These Terms are governed by the laws of the Republic of Botswana. Any disputes that cannot be resolved through our in-app process will be heard in the courts of Gaborone.
14. Changes to these Terms
We may update these Terms occasionally. Material changes will be emailed to you at least seven days before they take effect. Continuing to use PrimeDrive after that date means you accept the updated Terms.
